Bu anlamda objektif ve herkes i\u00e7in uyulmas\u0131 zorunlu yaz\u0131l\u0131 hukuk kurallar\u0131n\u0131n yan\u0131nda, \u0130ngiliz Common Law sisteminde oldu\u011fu gibi \u00f6rf-adet kurallar\u0131yla da su\u00e7 ve ceza konulmas\u0131 m\u00fcmk\u00fcnd\u00fcr[605]. Yeter ki su\u00e7 ve ceza \u00f6ng\u00f6ren h\u00fck\u00fcm a\u00e7\u0131k, anla\u015f\u0131labilir ve ula\u015f\u0131labilir olsun. Maddesine g\u00f6re ulusal hukuk kurallar\u0131n\u0131n yan\u0131nda s\u00f6zle\u015fmeler, gelenek ve uygar uluslarca benimsenmi\u015f bulunan genel ilkelerden olu\u015fan uluslararas\u0131 hukuk kurallar\u0131 da su\u00e7 ve ceza a\u00e7\u0131s\u0131ndan bir kaynak de\u011ferini ta\u015f\u0131maktad\u0131r[606]. Bu d\u00fczenleme yasamaya, Silahl\u0131 Kuvvetlerle ilgili d\u00fczenleme yaparken ki\u015fi h\u00fcrriyetini s\u0131n\u0131rlay\u0131c\u0131 disiplin cezas\u0131 verebilme yetkisi tan\u0131yan yasa \u00e7\u0131karabilme konusunda izin veren bir h\u00fck\u00fcm niteli\u011findedir. Maddedeki d\u00fczenlemede \u201c\u2026kanunla istisnalar getirilebilir\u201d ifadesi emredici de\u011fil izin verici mahiyettedir[566],. Yasama gerekli g\u00f6r\u00fcrse disiplin amirlerinin h\u00fcrriyeti ba\u011flay\u0131c\u0131 nitelikte ceza verebilmelerine imkan tan\u0131yan d\u00fczenlemeleri kald\u0131rabilir.<\/p>\n<p>Dolay\u0131s\u0131yla internette kumar oynamak kabahattir.\u0130nternette kumar oynamak i\u00e7in verilecek idari para cezas\u0131 2015 y\u0131l\u0131 i\u00e7in 208 TL 2016 y\u0131l\u0131 i\u00e7im 219 TL olarak uygulanmaktad\u0131r. Ayr\u0131ca belirtmekte fayda var ki, 6413 say\u0131l\u0131 Kanun 19\/1(i)f\u0131kras\u0131nda \u201cKumar oynamak\u201d YANLIZ BA\u015eINA VE ALI\u015eKAN\u015eLIK OLMAKSIZIN \u201cHizmet yerini terk etmeme\u201d cezas\u0131n\u0131 gerektiren disiplinsizlikler aras\u0131nda say\u0131l\u0131rken 7068 say\u0131l\u0131 Kanun\u2019un 8\/6\/n f\u0131kras\u0131nda kumar oynamak disiplinsizli\u011fi Meslekten \u00e7\u0131karma cezas\u0131n\u0131 gerektiren fiiller aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. \u00c7\u00fcnk\u00fc, hem h\u00fck\u00fcmetten, hem de T\u0130B&#8217;in de ba\u011fl\u0131 bulundu\u011fu Bilgi Teknolojileri \u0130leti\u015fim Kurumu&#8217;ndan (BTK) yap\u0131lan a\u00e7\u0131klamalarda, &#8220;Twitter y\u00f6netiminin, mahkeme karar\u0131yla \u00e7\u0131kar\u0131lmas\u0131 istenen i\u00e7erikleri kald\u0131rmad\u0131\u011f\u0131, bu nedenle sitenin kapat\u0131ld\u0131\u011f\u0131&#8221; duyuruldu. Ancak, yukar\u0131da verdi\u011fimiz &#8220;sitenin t\u00fcm\u00fcn\u00fcn yay\u0131n\u0131n\u0131 durdurma&#8221;ya ili\u015fkin yasa h\u00fckm\u00fcnde &#8220;mahkeme kararlar\u0131na uymamak&#8221; bir &#8220;kapatma&#8221; gerek\u00e7esi olarak say\u0131lm\u0131yor. 5651 Say\u0131l\u0131 \u0130nternet Ortam\u0131nda Yap\u0131lan Yay\u0131nlar\u0131n D\u00fczenlenmesi ve Bu Yay\u0131nlar Yoluyla \u0130\u015flenen Su\u00e7larla M\u00fccadele Edilmesi Hakk\u0131nda Kanun&#8217;da de\u011fi\u015fiklik yapan yasa, torba yasa i\u00e7inde 5 \u015eubat&#8217;ta TBMM Genel Kurulu&#8217;ndan ge\u00e7ti. Cumhurba\u015fkan\u0131&nbsp;Abdullah G\u00fcl&#8217;\u00fcn baz\u0131 d\u00fczeltmeler yap\u0131lmas\u0131 \u015ferhiyle onaylad\u0131\u011f\u0131 yasa y\u00fcr\u00fcrl\u00fc\u011fe girerken &#8220;sans\u00fcr&#8221; tart\u0131\u015fmalar\u0131 ya\u015fand\u0131. H\u00fck\u00fcmetin, yasa de\u011fi\u015fikli\u011fi s\u0131ras\u0131nda \u00f6ne s\u00fcrd\u00fc\u011f\u00fc &#8220;yeni d\u00fczenlemeyle art\u0131k internet sitelerinin tamamen kapat\u0131lmas\u0131 uygulamas\u0131ndan vazge\u00e7iliyor, sitelerden sadece \u015fik\u00e2yet\/dava konusu olan i\u00e7erikler \u00e7\u0131kar\u0131lacak&#8221; iddias\u0131 Twitter&#8217;\u0131n kapat\u0131lmas\u0131yla \u00e7\u00f6kt\u00fc.Peki Twitter nas\u0131l kapat\u0131ld\u0131, haber <a href=\"https:\/\/bem.stikesalfatah.ac.id\/2024\/03\/25\/nternet-altyap-sorgulama-fiber-altyap-sorgulama-27\/\">paribahis<\/a> de neden kapat\u0131lma riski alt\u0131nda? (2) Dava a\u00e7ma s\u00fcresi, cezan\u0131n kesinle\u015fmesinden itibaren ba\u015flar. Ancak T\u00fcrk karasular\u0131 d\u0131\u015f\u0131ndaki gemilerde verilen cezalarda, dava a\u00e7ma s\u00fcresi geminin ba\u011fl\u0131 bulundu\u011fu \u00fcsse\/limana d\u00f6nmesiyle ba\u015flar. (4) Milli Savunma Bakanl\u0131\u011f\u0131 veya \u00fcst komutanl\u0131k disiplin kurullar\u0131 itiraz\u0131 yerinde g\u00f6r\u00fcrse yeni karar\u0131 kendisi verir. (3) Subaylar\u0131n tahkikat\u0131nda astsubay \u00fcye yerine g\u00f6rev yapmak \u00fczere ayr\u0131ca bir subay \u00fcye belirlenir ve g\u00f6revlendirilir. Disiplinsizlik yapan\u0131n ast\u0131 konumunda olan \u00fcyelerin yerine yedek \u00fcyelerden, yedek \u00fcyeler aras\u0131nda da uygun nitelikte personel bulunmuyor ise birlik veya kurum i\u00e7erisinden ge\u00e7ici g\u00f6revlendirme yap\u0131l\u0131r.<\/p>\n<p>Te\u015fkilat\u0131nda tefti\u015f kurullar\u0131 bulunmayan birliklerde ise, bir veya birka\u00e7 r\u00fctbeli personel muhakkik\/tahkikat heyeti s\u0131fat\u0131yla inceleme ve soru\u015fturma yapmakla g\u00f6revlendirilmektedir. Bunlar\u0131n belirlenmesi konusunda kural olarak soru\u015fturma emri veren amirin takdir yetkisi s\u00f6z konusudur. G\u00f6revlendirilecek ki\u015fi veya heyet ba\u015fkan\u0131n\u0131n unvan ve kadro bak\u0131m\u0131ndan hakk\u0131nda soru\u015fturma yap\u0131landan daha \u00fcst ya da en az\u0131ndan ayn\u0131 stat\u00fcye sahip olmas\u0131 gerekir[346]. Maddesi uyar\u0131nca fesat ve isyan halinde her \u00fcst, emir ve komuta i\u015fini \u00fczerine almakla g\u00f6revlidir. B\u00f6yle durumlar olu\u015ftu\u011funda emir ve komuta i\u015fini devralan \u00fcst, amir konumuna ge\u00e7mektedir.<\/p>\n<p>Maddesinde 5170 say\u0131l\u0131 Kanunla yap\u0131lan de\u011fi\u015fiklik sonras\u0131 disiplin amirlerince oda hapsi cezas\u0131n\u0131n verilemeyece\u011fini \u0130kinci B\u00f6l\u00fcmde ayr\u0131nt\u0131l\u0131 \u015fekilde izah etmi\u015ftik. Ancak uygulamada bu ceza verilmeye devam etti\u011fi gibi AY\u0130M de oy\u00e7oklu\u011fuyla da olsa bu cezan\u0131n verilebilece\u011fi y\u00f6n\u00fcnde kararlar verilmektedir[743]. Burada irdelenmesi gereken bir sorun, disiplin amirlerince verilen t\u00fcm disiplin cezalar\u0131n\u0131n yarg\u0131 denetimi d\u0131\u015f\u0131nda olup olmad\u0131\u011f\u0131d\u0131r. Yukar\u0131da a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere Askeri Y\u00fcksek \u0130dare Mahkemesinin de oy\u00e7oklu\u011fuyla benimsedi\u011fi g\u00f6r\u00fc\u015f olan oda hapsi disiplin cezas\u0131 ile ilgili normlar \u00e7at\u0131\u015fmas\u0131n\u0131n Anayasa \u2013 S\u00f6zle\u015fme \u00e7at\u0131\u015fmas\u0131 oldu\u011fu kabul edildi\u011finde, 5170 say\u0131l\u0131 Kanunla Anayasan\u0131n 90. Maddesinde yap\u0131lan de\u011fi\u015fiklikten sonra dahi disiplin amirlerince idari kararla oda hapsi disiplin cezas\u0131 verilmesinde hukuka ayk\u0131r\u0131l\u0131k bulunmamaktad\u0131r. Anayasa Mahkemesi gerek\u00e7esinde; Anayasa koyucunun, Anayasa\u2019n\u0131n 38.<\/p>\n<p>Mesle\u011fini g\u00f6lgeleyecek, itibar\u0131n\u0131 sarsacak t\u00fcrden olu\u015fumlar i\u00e7erisinde yer almamal\u0131d\u0131r. Doktor veya hastanelerin su\u00e7land\u0131\u011f\u0131 haberlerde mutlaka onlar\u0131n da g\u00f6r\u00fc\u015f\u00fcne ba\u015fvurulmal\u0131d\u0131r. Hasta haklar\u0131 g\u00f6zetilerek hastan\u0131n ses ve g\u00f6r\u00fcnt\u00fc kayd\u0131 izinsiz al\u0131nmamal\u0131d\u0131r. Sa\u011fl\u0131k kurulu\u015flar\u0131nda ara\u015ft\u0131rmalar yapan, bilgi ve g\u00f6r\u00fcnt\u00fc almaya \u00e7al\u0131\u015fan gazeteci, kimli\u011fini belirtmeli ve girilmesi yasak b\u00f6l\u00fcmlere ancak yetkililerin izniyle girmelidir. Ara\u015ft\u0131rmalar\u0131 destekleyen kurulu\u015flar a\u00e7\u0131k\u00e7a belirtilmeli, bilimsel kan\u0131ta dayal\u0131 olmayan tan\u0131 ve tedavi y\u00f6ntemlerine haberlerde yer verilmemelidir. Cemiyet Sayman\u0131nca teslim al\u0131nan Al\u0131nd\u0131 Belgeleri, Al\u0131nd\u0131 Belgesi Kay\u0131t Defterine kaydedilir. Al\u0131nd\u0131 Belgelerinin, eski ve yeni saymanlar aras\u0131nda tutanakla devir teslimi yap\u0131l\u0131r. Forma veya s\u00fcrekli form \u015feklinde bast\u0131r\u0131lan al\u0131nd\u0131 belgeleri de ba\u015flang\u0131\u00e7lar ve biti\u015f numaralar\u0131 elli as\u0131l ve elli ko\u00e7an yapra\u011f\u0131n\u0131 ihtiva edecek \u015fekilde grupland\u0131r\u0131larak yukar\u0131da belirtilen usule g\u00f6re kaydedilir. \u00dcyeler sonraki se\u00e7imlerde ayn\u0131 ya da ba\u015fka organlara yeniden se\u00e7ilebilir.<\/p>\n<p>Daha \u00f6nce \u201cAvukatlar\u0131n Aranmas\u0131\u201d ba\u015fl\u0131kl\u0131 bir yaz\u0131 kaleme alm\u0131\u015ft\u0131m. O yaz\u0131da, avukatlar\u0131n ne \u015fekilde aranabilece\u011fini a\u00e7\u0131klam\u0131\u015f, \u201cevleviyet\u201d kural\u0131ndan ve \u00f6nleme aramas\u0131 ile ilgili avukat\u0131n \u00fczeri ile e\u015fyas\u0131n\u0131n aranabilece\u011fine dair a\u00e7\u0131k d\u00fczenleme olmad\u0131\u011f\u0131ndan, 1136 say\u0131l\u0131 Avukatl\u0131k Kanunu\u2019nun 58. F\u0131kras\u0131n\u0131n son c\u00fcmlesinin uygulanmas\u0131 gerekti\u011fine i\u015faret etmi\u015ftim. Kanaatimizce arama, sadece elle d\u0131\u015ftan, elbise ve sair e\u015fyada yap\u0131lacak aramay\u0131 de\u011fil, X-ray, dedekt\u00f6r, duyarl\u0131 kap\u0131 gibi teknik cihazlarla yap\u0131lan aramay\u0131 da kapsar. Teknik cihazlarla yap\u0131lan bu aramalar da, \u201ctarama\u201d ad\u0131 ile me\u015frula\u015ft\u0131r\u0131lamaz. Aynen do\u011frudan ortam veya uzaktan cihazla veya telefonun dinlenmesinde bunlar\u0131n t\u00fcm\u00fcn\u00fcn \u201cdinleme\u201d say\u0131lmas\u0131 gibi, ister elle ve isterse cihazla yap\u0131ls\u0131n, bir kimsenin \u00fczerinde veya yan\u0131nda bulunan e\u015fyas\u0131n\u0131n kontrol\u00fcn\u00fc \u00f6ng\u00f6ren usuller de \u201carama\u201d olarak nitelendirilmelidir. 2911 say\u0131l\u0131 Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015fleri Kanunu\u2019nun \u201cToplant\u0131 ve y\u00fcr\u00fcy\u00fc\u015fe silahl\u0131 kat\u0131lanlar\u201d ba\u015fl\u0131kl\u0131 mevcut 33. Maddenin (b) bendinde1 say\u0131lan silah veya ara\u00e7lar\u0131 ta\u015f\u0131yarak kat\u0131lanlar, alt\u0131 aydan \u00fc\u00e7 y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131l\u0131r.<\/p>\n<p>Yasama organ\u0131 bu h\u00fckme dayanarak bir k\u0131s\u0131nt\u0131 getirmedi\u011fi takdirde s\u0131rf bu Anayasa h\u00fckm\u00fcne dayan\u0131larak Silahl\u0131 Kuvvetler mensuplar\u0131 hakk\u0131nda disiplin ceza kararlar\u0131na kar\u015f\u0131 yarg\u0131 yolunun kapal\u0131 oldu\u011fu sonucuna var\u0131lamaz. Yine yasama organ\u0131 yarg\u0131 denetimi k\u0131s\u0131nt\u0131s\u0131n\u0131 d\u00fczenleyen yasa kural\u0131n\u0131 y\u00fcr\u00fcrl\u00fckten kald\u0131rd\u0131\u011f\u0131 takdirde Anayasaya ayk\u0131r\u0131l\u0131ktan s\u00f6z edilemez. Her iki Anayasa kural\u0131 da yasama organ\u0131na yetki veren bir d\u00fczenleme olup, Anayasan\u0131n 125. Maddesindeki Cumhurba\u015fkan\u0131n\u0131n tek ba\u015f\u0131na yapaca\u011f\u0131 i\u015flemler ile Y\u00fcksek Askeri \u015euran\u0131n kararlar\u0131n\u0131n yarg\u0131 denetimi d\u0131\u015f\u0131nda oldu\u011fu, 159. Maddesindeki, Hakimler ve Savc\u0131lar Kurulunun kararlar\u0131na kar\u015f\u0131 yarg\u0131 mercilerine ba\u015fvurulamayaca\u011f\u0131 \u015feklindeki, yasama organ\u0131na takdir yetkisi vermeden a\u00e7\u0131k\u00e7a yarg\u0131 yolunu kapatan bir h\u00fck\u00fcm i\u00e7ermemektedir. Buradan \u00e7\u0131kan sonu\u00e7 ortada bir Anayasa-S\u00f6zle\u015fme \u00e7at\u0131\u015fmas\u0131 de\u011fil kanun-s\u00f6zle\u015fme \u00e7at\u0131\u015fmas\u0131 oldu\u011fudur.<\/p>\n<ul>\n<li>Bu yaz\u0131l\u0131 metin hak sahipli\u011finin tespiti amac\u0131yla zaman i\u00e7erikli elektronik imza ile muhafaza edilmektedir.<\/li>\n<li>H\u00e2liyle TBMM\u2019nin de kendi \tse\u00e7imlerini ve Cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imini yenileyerek bu birli\u011fi sa\u011flama \timk\u00e2n\u0131 vard\u0131r.<\/li>\n<li>\u201c\u0130\u015fkence ve Eziyet\u201d ba\u015fl\u0131kl\u0131 TCK m.94\/1\u2019e g\u00f6re; \u201cBir ki\u015fiye kar\u015f\u0131 insan onuruyla ba\u011fda\u015fmayan ve bedensel veya ruhsal y\u00f6nden ac\u0131 \u00e7ekmesine, alg\u0131lama veya irade yetene\u011finin etkilenmesine, a\u015fa\u011f\u0131lanmas\u0131na yol a\u00e7acak davran\u0131\u015flar\u0131 ger\u00e7ekle\u015ftiren kamu g\u00f6revlisi hakk\u0131nda \u00fc\u00e7 y\u0131ldan oniki y\u0131la kadar hapis cezas\u0131na h\u00fckmolunur\u201d.<\/li>\n<\/ul>\n<p>Marka hakk\u0131na tecav\u00fcz; ba\u015fta 556 say\u0131l\u0131 Markalar\u0131n Korunmas\u0131 Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname\u2019nin 5833 say\u0131l\u0131 Kanunun 2. Maddeleri ile d\u00fczenlenen 61 ve 61\/A maddelerinde , \u015fu an ise 6769 say\u0131l\u0131 S\u0131nai M\u00fclkiyet Kanunu\u2019nun 29 ve 30. Cezai h\u00fck\u00fcmleri i\u00e7eren bu d\u00fczenlemelerin her ikisinde de yapt\u0131r\u0131m \u015fikayet \u015fart\u0131na ba\u011flanm\u0131\u015ft\u0131r, yani ilgili ki\u015finin \u015fikayeti olmadan, soru\u015fturma ba\u015flat\u0131lamayacak veya \u015fikayetin geri al\u0131nmas\u0131 halinde, kovu\u015fturma evresine ge\u00e7ilmi\u015f olsa da ki\u015fi cezaland\u0131r\u0131lamayacakt\u0131r. Hukuka ayk\u0131r\u0131 yol ve y\u00f6ntemlerle elde edilen delillerin \u015f\u00fcpheli ve san\u0131k aleyhine kullan\u0131lamayaca\u011f\u0131 hususunda, Anayasa m.38\/6, CMK m.206\/2-a ve m.217\/2 gere\u011fince teredd\u00fct olmad\u0131\u011f\u0131 tart\u0131\u015fmas\u0131zd\u0131r. Nitekim arama tedbiri; Anayasa m.13, m.20\/2 ve m.21\u2019de g\u00f6sterilen \u00e7er\u00e7evede, hakimin veya kanunla yetkili k\u0131l\u0131nan makam\u0131n yaz\u0131l\u0131 emri ile ilgili kanunda g\u00f6sterilen \u015fekil ve \u015fartlarda tatbik edilmek zorundad\u0131r. Aksi halde yap\u0131lan arama, buna ba\u011fl\u0131 muhafaza alt\u0131na alma veya elkoyma ile bu yolla elde edilen deliller hukuka ayk\u0131r\u0131 olup, yarg\u0131lamada \u015f\u00fcpheli ve san\u0131k aleyhine kullan\u0131lamaz. Anayasa Mahkemesi yetki a\u015f\u0131m\u0131nda bulunmad\u0131\u011f\u0131 gibi, yasama ve y\u00fcr\u00fctme organlar\u0131n\u0131n yetki alanlar\u0131na da m\u00fcdahale etmemi\u015ftir. Cumhuriyet savc\u0131s\u0131n\u0131n CMK m.103\/2\u2019ye g\u00f6re re\u2019sen adli kontrol\u00fc veya tutuklamay\u0131 kald\u0131rma yetkisi vard\u0131r. Kovu\u015fturmaya yer olmad\u0131\u011f\u0131 karar\u0131nda \u015f\u00fcpheli zaten serbest kal\u0131r, ancak 103. F\u0131kras\u0131nda Cumhuriyet savc\u0131s\u0131n\u0131n, \u015f\u00fcphelinin adli kontrol alt\u0131na al\u0131narak serbest b\u0131rak\u0131lmas\u0131 sulh ceza hakiminden isteyebilme yetkisi varken, hakk\u0131nda tutuklama karar\u0131 verilmi\u015f \u015f\u00fcpheli ve m\u00fcdafinin de ayn\u0131 istemde bulunabilece\u011fi belirtilmi\u015ftir.<\/p>\n<p>Maddesine g\u00f6re, memurlar, e\u015fleri, re\u015fit olmayan \u00e7ocuklar\u0131n\u0131n s\u00fcrek\u00adli kazan\u00e7 getiren faaliyetlerini, 15 g\u00fcn i\u00e7inde kurumlar\u0131na yaz\u0131l\u0131 olarak bildirmek zorundad\u0131rlar[183]. Bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerine getiril\u00admemesi, k\u0131nama cezas\u0131n\u0131n uygulanmas\u0131n\u0131 gerektirir. TSK\u2019da \u00e7al\u0131\u015fan Devlet memurlar\u0131 k\u0131l\u0131k ve k\u0131yafet ile ilgili d\u00fczenleyici i\u015flemlere[181] ve emirlere uymak zorundad\u0131r. K\u0131l\u0131k ve k\u0131yafetle ilgili d\u00fczenlemeler, kamu personelinin Atat\u00fcrk devrim ve ilkelerine uygun, uygar, a\u015f\u0131r\u0131l\u0131\u011fa ka\u00e7mayacak \u015fekilde, sade bir k\u0131l\u0131k ve k\u0131yafette olmalar\u0131n\u0131, k\u0131l\u0131k ve k\u0131yafette birlik ve b\u00fct\u00fcnl\u00fck i\u00e7inde bulunmalar\u0131n\u0131 sa\u011flamay\u0131 ama\u00e7lar. Bu amaca ters d\u00fc\u015fen k\u0131l\u0131k ve k\u0131yafet\u00adler bentteki disiplin cezas\u0131n\u0131 gerektirir. \u201cAstlar\u0131na hizmetle ilgisi olmayan emir verenler, astlar\u0131ndan hediye isteyenler veya bor\u00e7 alanlar 10 g\u00fcnden 2 aya kadar oda veya g\u00f6z hapsi cezas\u0131 ile cezaland\u0131r\u0131l\u0131rlar\u201d (477 SK m.53). K\u0131sa s\u00fcreli izin s\u00fcresini ge\u00e7irme su\u00e7unun maddi unsuru failin, k\u0131tas\u0131ndan veya g\u00f6revini yapmakta oldu\u011fu yerden izin alarak ayr\u0131lmas\u0131ndan sonra d\u00f6nmeye mecbur bulundu\u011fu g\u00fcnden itibaren 6 g\u00fcne kadar \u00f6z\u00fcrs\u00fcz gelmemesidir. \u015eayet iznin ge\u00e7irilmesi bir \u00f6zre dayan\u0131yorsa su\u00e7 olu\u015fmaz.<\/p>\n<p>Maddesinin, disiplin kurulu \u00fcyelikleri bak\u0131m\u0131ndan DY ile i\u015flemez hale getirilmesinin, normlar hiyerar\u015fisine ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esiyle ele\u015ftirilmektedir (O\u011fuz Sancakdar, Disiplin Yapt\u0131r\u0131m\u0131 Olarak Devlet Memuriyetinden \u00c7\u0131karma ve Yarg\u0131sal Denetimi, Yetkin Yay\u0131nevi, Ankara 2001, s.283). Ancak disiplin kurulu \u00fcyeli\u011fi yapacak ki\u015filerin tarafs\u0131zl\u0131klar\u0131n\u0131n ve g\u00fcvenilirliklerinin sa\u011flanabilmesi i\u00e7in, adli sicilden silinse dahi disiplin cezas\u0131 almam\u0131\u015f olmalar\u0131n\u0131n aranmas\u0131 daha uygun bir y\u00f6ntemdir. Ankara B\u00f6lge \u0130dare Mahkemesi, yarg\u0131 ba\u011f\u0131\u015f\u0131kl\u0131\u011f\u0131na ra\u011fmen Anayasan\u0131n 159 ve 2641 say\u0131l\u0131 HSYK Kanununun 12\/son maddesine g\u00f6re HSYK\u2019 nun disiplin cezalar\u0131 da dahil kararlar\u0131na kar\u015f\u0131 yarg\u0131 yolu kapal\u0131 ise de, Adalet Bakan\u0131na hakaret su\u00e7undan beraat eden savc\u0131ya, ayn\u0131 sebeple verilen k\u0131nama cezas\u0131ndan dolay\u0131, Anayasan\u0131n 125. Maddesi kar\u015f\u0131s\u0131nda tam yarg\u0131 davas\u0131 a\u00e7\u0131labilece\u011fine ve beraat y\u00f6n\u00fcndeki yarg\u0131 karar\u0131nda keyfi hakaret etti\u011fi anla\u015f\u0131lan HSYK\u2019nun ceza\u00ee i\u015fleminden do\u011fan manevi zarar\u0131n tazmininin gerekti\u011fine karar vermi\u015ftir[811]. Bu d\u00fczenlemelerden anla\u015f\u0131laca\u011f\u0131 \u00fczere, TSK mensuplar\u0131na ili\u015fkin disiplin cezalar\u0131na kar\u015f\u0131 yarg\u0131 yolu kapal\u0131 tutulmu\u015ftur. Bu yarg\u0131 denetimi k\u0131s\u0131nt\u0131s\u0131n\u0131n tam yarg\u0131 davalar\u0131n\u0131 da kapsay\u0131p kapsamad\u0131\u011f\u0131, i\u015flem iptal davas\u0131na konu edilmese ve bu y\u00f6ndeki talep reddedilse bile i\u015flemden do\u011fan zarar\u0131n tazminin istenip istemeyece\u011fi konusunu a\u00e7\u0131kl\u0131\u011fa kavu\u015fturmak gerekmektedir.
